Aside from responding to examiners’ rejections, applicants have little incentive to narrow claims. Accordingly, as we show below, the vast majority of independent claims grow longer during prosecution, in response to examiner rejections. Thus, on an institutional basis we should expect a correlation between the narrowness of claims and the length of claims, ceteris paribus.
